Case Study Analysis and Action Plan CASE STUDY ANALYSIS 1. What is the title and citation of the case study you examined? Jodi/Special Education Services 2. What are the ethical issues presented in the case study (e.g., bias issues)? Jodi was forced to do an evaluation that she was not really capable of doing. She was also denied services by the school district because they felt like there was nothing that they could do for her. 3. What legal aspects are present in the case study (e.g. federal law, state regulations, legal rights of stakeholders)? The Individuals with Disabilities Act and The Education for All Handicapped Children Act, FAPE 4. What foundational principles and current issues are embedded within the case study? How did both of these (foundational aspects and current issues) contribute to the scenario described in the case study? [CEC 6.2] The whole process of the evaluation was not ethical because it was like they really did not want to help her from the start. They did not consider the CEC standards. 5. In what ways did diverse perspectives or personalities impact the scenario described in the case study? [CEC 6.3] Mr. and Mrs. Singer seemed to be very frustrated and upset and they did not understand why it would be such an intense evaluation when she had already told them Jodi’s conditions. They can’t understand why Mrs. White is so blunt about the whole situation. It made the situation harder for both parties. ACTION PLAN 1. Assume the scenario described in the case study occurred at the school/district where you are employed. What steps would you implement (or recommend for implementation)? You may elect to create a plan that precedes the case study—detailing steps that could have been in place to avoid the episode, or your plan may specify actions to employ at the conclusion of the case study. The plan should include enough detail to support your responses to items #2 - #7 below. If this is something that occurred at my school I would do whatever it takes to make sure that the students rightfully get the help that they are obligated to get. I would explain to the parents that we can’t just give them services only based on what they have said we still have to go through a process. I will let them know that an evaluation will have to be done even if the student is not really capable of doing so. By law we have a process that we have to go by. The first step will be getting permission to even go through with an evaluation. Secondly, we will gather as a group and decide if the child is considered as a child with a disability as defined by IDEA. I will explain to the parents that there is a certain category of disabilities that will qualify under IDEA. If the kid does not qualify then we can look at other services
Case Study Analysis and Action Plan that we might can help with if the child does qualify we will then proceed to the next step. The next step would be to set up an IEP meeting. During the meeting the IEP will be written. After the meeting is complete services will be provided. You would think that this is the end of the process but it is not. You will then have to monitor the process and make sure that it is working for that child and give an update to the parents. In this case and the severity of Jodi’s disability it is very important that you find out what will work for her. It may not be of much help but anything will be better than nothing. This can be a rough time for the parents. Our school district does not offer mentoring for the parents that have kids with disabilities but I will make sure that I provide them with information about advocates in the surrounding areas. They will also have me and the school LEA to communicate with. Our local Co-op will provide parents with helpful information. 2. Supply a written rationale for the decisions you made within the action plan. How does the plan reflect ethical principles? How does the plan reflect professional practice standards? Is your plan of action legally sound (make appropriate citations) ? [CEC 6.1] According to the U.S. Department of Education’s Individuals with Disabilities Education Act (IDEA) website The Individuals with Disabilities Education Act (IDEA) is a law that makes available a free appropriate public education to eligible children with disabilities throughout the nation and ensures special education and related services to those children. When creating this action plan it was definitely the most important thing to me because I have to make sure that this child receives the services that she needs. Although I wanted to give this student services because I felt so sorry for her and her family I could not do that because I have to make sure that I follow the CEC standards. According to the CEC Initial Level Special Educator Preparation Standard 6.1, “ Beginning special education professionals use professional Ethical Principles and Professional Practice Standards to guide their practice. It is not about what I want, it's about what we are allowed to do as a special education teacher. 3. Describe how your knowledge of special education foundations and of current special education issues influenced the development of your action plan. [CEC 6.2] According to the CEC Initial Level Special Educator Preparation Standard 6.2, “ Beginning special education professionals understand how foundational knowledge and current issues influence professional practice.” This is my 4th year in the Special Education field. I have seen a lot of different things that have happened in the field of special education. Reading different case studies and putting my knowledge to it makes me want to do things my way but by the law. I also know that I cannot go by my opinions. There are laws that you have to go by. When creating the action plan I had to take all of these things into consideration. 4. How does your action plan reflect your understanding of the complexity of human issues among stakeholders in the special education process? [CEC 6.3] My action plan reflects my understanding of the complexity of human issues among stakeholders in the special education process by showing the parents that I want what is best for their child. In my action plan you can see that I have made sure that I explained things to the parents as thoroughly as I possibly could have. It is one thing that they are having to go through something that is so traumatic but to not know the process of special education will make it worse. So it is very important to make sure that as a Special Education teacher I explain what I know and explain the laws to the best of my ability. I am not expecting it to make them not be upset or worried but I am hoping by explaining it they will have a better understanding.
