QUESTION ONE
Sarina Rossi has recently completed her law degree as well as a year of Supervised Legal
Training, and is now contemplating her admission to legal practice.
Sarina was previously a successful executive in an aggressive hedge fund corporation, and is
concerned about some events from her past which she might need to disclose to the
Victorian Legal Admissions Board (VLAB) when she applies for admission, viz:
i.
ii.
iii.
iv.
At her first office Christmas party for the hedge fund, Sarina drank too much and
made some suggestive comments to a male colleague. She was subsequently
reported to the company's HR department for sexual harassment. After a brief
inquiry, she was let off with a warning. She has been careful never to get drunk with
colleagues since that time.
In her third year at the hedge fund, she was promoted to Senior Fund Manager - the
youngest person to achieve that milestone in the firm's history. To celebrate, she
went to a nightclub with some friends. The police raided the club, and Sarina
(amongst others) was charged with cocaine possession. As this was her first criminal
charge, the magistrate did not record a conviction, but ordered Sarina to perform
100 hours of community service.
During her early years at the hedge fund Sarina took out a personal loan to purchase
a Porsche - she wanted to impress her colleagues and clients. However, Sarina found
herself unable to meet the repayments at one point when her spending got out of
control. The finance company repossessed the car.
While she worked for the hedge fund, Sarina was also President of her local croquet
club. At one point, the club was in dire financial straits and Sarina directed the
Treasurer to alter the accounts to make sure the club would not be shut down at the
next Annual General Meeting. When the club's Secretary found out about this, he
was outraged and gave an interview with the local paper denouncing Sarina's
behaviour. The club's finances recovered, and no other consequences ever resulted
from this event.
