A controversial topic that many protested for was, freedom of speech. After many years of wanting to be heard, Americans finally achieved the assurance of having a voice. The Bill of Rights was passed on December 15, 1791; commencing with the First Amendment. The First Amendments defends freedom of speech, press, religion, assembly and petition. Stated in the U.S. Constitution, the First Amendment declares "Congress shall make no law… abridging the freedom of speech.” Thus, meaning that citizens cannot be imposed of civil liability from what they say or write with exceptions. Even though freedom of speech recognizes many arguments, discussions, and expression, it will only be valid through the qualifications the First Amendments states with the exceptions included. Highly entrenched in the constitution, freedom of speech is one of the most treasured freedoms that has been protected once achieved. Many back in the day, fought for this privilege that we now have. Back then, they were not allowed to speak against the government with topics such as, unfair laws, taxation, etc. With such privilege though, there had to be some clarifications. Freedom of speech does not imply that there is a right to speak anywhere and at any time. There is a time and place for everything. Thus, meaning that protestor can protest in areas that are neutral; being that they initially favor both sides. James Madison, a political theorist, was known as the father of the Bill of Rights. One of the most important amendments in the Bill of Rights is the right to freedom of speech, expression and media. In the Bill of Rights, the First Amendment states, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.” The First Amendment guarantees the citizens of America that they have the right to freely express themselves about anything, including political arguments and views. This amendment also guarantees the press/media the right to overtly publish their ideas on any topic in the newspaper. The purpose of this amendment is to assure America’s people that they shouldn’t worry about being censored or punished for the expression of their feelings because they are human just as everyone else.

The Founding Fathers knew what they were doing because they believed in power of ideas and debate, not censorship. After the Revolution, the States adopted their own constitutions, many of which contained a Bill of Rights. The Americans still faced the challenge of creating a central government for their new nation. In 1777 the Continental Congress adopted the Articles of Confederation, which were ratified in 1781. Under the Articles, the states retained their “sovereignty, freedom and independence,” while the national government was kept weak and inferior. Over the next few years it became evident that the system of government that had been chosen was not strong enough to completely settle and defend the frontier, regulating trade, currency and commerce, and organizing thirteen states into one union.

To begin, the very first amendment to the United States Constitution grants citizens with the freedom of speech. The freedom of speech is generally the right to express your own opinion without restrictions. Over the course of American history, many have taken the First Amendment right of freedom of speech and created wonderful things out of it. Alice Paul is an excellent example: she utilized her right to free speech and press to promote the equality of women and earned them the right to vote, in the midst of World War I. However, many take it the other way and create hate speeches where they tear down one particular group or individual or idea with their crude and blunt remarks. Yet, they are protected by the freedom of speech and the government cannot interfere with their actions, causing many to argue the First Amendment Right cannot be extended to anyone making hurtful remarks. Hate speeches need to be protected by the freedom of speech, as shown in legal documentation, moral issues, and the benefits it creates.

Like most democratic nations in the world, the United States has had its own fair share of issues with hate speech. There has been a lot of controversy over whether hate speech should be regulated. In analyzing the concept of free speech, one cannot ignore that it does not occur in a vacuum.
